Risk Information and Privacy Policy - Consent
IMPORTANT INFORMATION
1. During the act of tattooing, the tattoo ink pigments are inserted in the second layer of the skin (the dermis) with the use of one or more needles. Since the skin is injured and it is painful, the process is actually a bodily injury according to$ 223 Abs. 1 StGB (German law)
2. The condition of a tattoo is greatly influenced by the skin condition of the client. It is possible that between the fresh tattoo and the healed tattoo there will be slight differences in shape and colour. The tattoo will live and age with the rest of your skin; even more so than bare skin, a tattooed skin will be particularly affected by strong solar radiation (UV). Activities which expose you to frequent or intense radiations (e.g.: sunbathing, solarium, working outdoors, etc.) will accelerate the ageing process of the tattoo; the colours will fade and the contours of the tattoo will become blurred. This can be countered with suitable measures (e.g.: renouncement of solarium, sun protection, good skin care).
3. In rare cases, despite the utmost professionalism and care, as well as tried & tested industry techniques and working materials, it may occur that during or after the act of tattooing the client can experience some side effects and/or complications (e.g.: circulatory problems, chills, bleeding, swelling of the skin with itchiness and redness, slight scarring, blow-outs, photosensitivity of the tattoo, occurrence of keloids or sarcoidosis, allergic and non-allergic foreign body reactions). In very rare cases, despite the greatest care with regard to hygiene and cleanliness by the tattoo artist and the tattoo studio (but usually as a result of improper after-treatment of the tattoo by the client), infections and/or germs are spread. Also in extremely rare cases, a strong intolerance (e.g.: allergic reaction) to certain tattoo pigments/colours can occur, which could lead to health complications and could require surgery in the worst cases. Should such a case occur, we kindly ask the client to inform us and consult a doctor immediately. On the basis of § 52 Para. 2 SGB V (German law) the statutory health insurance takes recourse against the client in the event of a complication.
4. If a design is tattooed over an existing tattoo (e.g.: cover-up), it is important to note that it is not possible to predict exactly how much the new tattoo will cover the old one. It is possible that the old tattoo will still show through the new one. Furthermore, it cannot be ruled out that there may be interactions with the already existing tattoo during or after the act of tattooing the new one.
5. If a design is tattooed over an existing tattoo, or stretch marks, or scars, there is a particular risk that the condition of the new tattoo will be affected by the initial condition of the skin. In such cases the new tattoo may differ from the original design and may heal unpredictably; this is because the skin may be impaired in its colour absorption or may be particularly susceptible to scarring.
6. Since the tattooing process is painful, it can lead to involuntary and unpredictable muscle twitches and movements from the client (e.g.: hypnic jerk, startle reflex). Despite being trained and prepared for such event, the tattoo artist is not always able to counteract such movements and can only try to minimise the consequences. In rare cases, the quality of the tattoo can be influenced, for example because the guidance of the needle cannot be uniform and exact, and therefore some irregularities may occur, especially in regards to fine lines and details.
7. In unusual cases, the ability of the skin to absorb tattoo pigment is limited by its nature (e.g.: over exposure to UV in the past, steroid abuse, etc.). Such cases are unfortunately unforeseeable and make it difficult to achieve an aesthetically satisfactory result.
DATA PROTECTION DECLARATION
Your tattoo artist will take photographs of the finished work. In some cases, studio staff may also take photographs and videos whilst the act of tattooing is carried out. You (the client) hereby expressly consent that these photographs and videos may be used online, on our website and our social media channels (e.g. lnstagram, Youtube, Tiktok etc.), as well as in printed publications and advertisements, beyond the permissible purpose pursuant to Art. 6 Para. 1(f) EU-DSGVO. This consent form also collects health data so that we can decide whether it is possible to carry out the act of tattooing without endangering your health and without affecting the results of your tattoo artist's work. Therefore, the act of tattooing cannot be carried out by your tattoo artist without this data collection. This data is special data within the meaning of Art. 9 EU GDPR. You (the client) hereby expressly consent that we will collect this data. We will not pass this data on to third parties but we will keep it for a period of 10 years (as required by law). After this period, this consent form will be destroyed.
DECLARATION
'I hereby declare that I read and understood the "important information" section of this consent form and I declare that I give my full consent to the act of tattooing being carried out by the tattoo artist. I understand that my tattoo artist is self-employed and that aftercare instructions have been explained to me by him/her. I confirm that a written aftercare advice leaflet containing more details information has been given to me and I understand that it is my responsibility to read and follow those instructions until my tattoo has fully healed. I understand that so called "touch-up" are only available at the discretion of the tattoo artist and that only he/she can carry out such act. Finally, I confirm that I requested this tattoo of my own free will, that the information I provided in this consent form is correct to the best of my knowledge, that I am over the age of 18 and that I am not currently under the influence of alcohol or drugs.'
